Terms of Service

1. Description of the Service

Mokabu is a Q&A management platform for conferences, webinars, lectures, and events. Our Service allows event organizers to create rooms where attendees can submit questions, vote on questions, and receive real-time moderation. The Service is currently provided free of charge during the beta period.

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 13, please do not use the Service or provide any personal information.

3. User Conduct

You are responsible for your own conduct and any content that you create, transmit, or display while using the Service. You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Service.

Prohibited conduct includes, but is not limited to:

• Uploading or sharing content that is unlawful, defamatory, obscene, fraudulent, or harmful.
• Violating the intellectual property rights of others.
• Attempting to disrupt the integrity or performance of the Service.

Content Moderation: Event organizers and moderators may approve, reject, or delete questions submitted in their rooms. Questions may be flagged as potential spam by our automated systems. We reserve the right to remove content that violates these Terms.

4. Third-Party Services

Our Service integrates with third-party services to provide authentication and other functionality:

• Google OAuth: You may sign in using your Google account. By doing so, you agree to Google's Terms of Service and Privacy Policy.
• Google reCAPTCHA: We use reCAPTCHA to prevent spam and abuse, subject to Google's Privacy Policy and Terms of Service.

5. Beta Service and Usage Limits

The Service is currently in beta and provided free of charge. During the beta period, the following limits apply:

• Maximum 5 rooms per user account
• Rate limits on question submissions and API usage

We reserve the right to change these limits or introduce paid plans in the future. Users will be notified of any changes at least 30 days in advance.

6. Intellectual Property

We retain all rights, title, and interest in and to the Service, including all related software, logos, and branding. You retain all rights to the content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content solely for the purpose of operating and providing the Service.

7. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. You use the Service at your own sole risk.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Hack Your Way s.r.o., its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, or other intangible losses, resulting from your access to or use of, or inability to access or use, the Service.

Our total liability to you for any and all claims arising from the use of the Service is limited to the amount of remuneration we have received from you for the use of the Service in the twelve (12) months preceding the claim.

As the Service is provided free of charge, you acknowledge that our total liability is therefore zero. In jurisdictions where the exclusion of all liability is not permitted, our liability shall be limited to a nominal amount of CZK 100 (one hundred Czech Korunas).

9. Termination

We may terminate or suspend your access to the Service at any time, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.

Account Deletion: You may request deletion of your account at any time by contacting us at info@mokabu.com with the subject line "Account Deletion Request." We will permanently delete your account and associated data within 30 days, as described in our Privacy Policy.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions.

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in the Czech Republic.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any significant changes by posting the new Terms on this page and updating the "Effective Date" at the top. For material changes that significantly affect your rights, we will also send an email notification to your registered email address. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
